Terms and Conditions
A. PRICES and PAYMENTS
1. A 50% deposit of the entire order will protect against any price increase for a period of 90 days from receipt of the deposit. Balances owing will need to be settled prior to product/service dispatch. The customer understands that the order is placed according to their unique and specific requirements, therefore, deposits are non-refundable should the customer change their mind. Ownership of goods will transfer to the customer once full payment has been received.
2. The delay of payment may result in a cancellation or a delay of contracted services, as well as additional fees to the customer, such as storage fees, re-schedule fee, etc. Such additional fees are non-refundable, and paid to the Discount Kitchen & Bath Cabinets Ltd. (hereinafter “DKBC”) service sub-contractors as a result of a cancellation and delay.
3. DKBC agrees to execute this contract in compliance with the relevant industrial and trade practices, while the customer agrees that any claim(s) for adjustment and/or modification shall not constitute a reason or excuse to the failure to pay the contract price in full. DKBC reserves the rights to take legal actions, including but not limited to putting a lien against the property of the job site in case the full payment is not received.
4. DKBC accepts debit card, cash, email-transfer, bank draft, credit card, cheque and direct bank deposit. Credit Card (Visa and MasterCard only) payments will incur a surcharge and it’s non-refundable. Personal cheques are accepted only for the down payment and DKBC needs sufficient time for the funds to be cleared.
5. DKBC reserves the rights to make any price changes to orders unless a deposit has been paid. DKBC endeavor to resolve but take no responsibility if items from a 3rd party supplier are out of stock or higher priced.
B. QUALITY (In compliance with “BC Residential Construction Performance Guide”)
1. The quality of the products supplied by DKBC will be equivalent to that of the display items at the DKBC showroom. So is the quality of installation services.
2. Scratches/Scuffs: Stained or painted wood surfaces shall be free of scratches or scuffs when viewed from a normal viewing position of 1.8m (6’) under normal lighting conditions.
3. Colour variation/knots/Grain: All wood products are made of natural solid wood. Therefore, colour variations, knots or different grain patterns are natural characteristics of wood and are not considered as a quality issue, and therefore are not covered by warranty.
4. Tolerance: All wood cabinets are subject to expand, shrink, distort, crack and/or bend in different circumstances. DKBC considers it as a quality issue only when the cabinets shrink, distort, crack and/or bend more than 1/8 inch during a normal environment. Open joint (hairline) cracks are unavoidable in wood cabinets, especially in color painted ones. DKBC will NOT consider hairline cracks as a quality issue.
5. Surface pits, shading, fissures or veins in stone countertops are naturally occurring characteristics of stone. Stone materials, both natural and man-made, do not resist stains.
C. WARRANTY CLAIM and RETURN/EXCHANGE
1. Unless otherwise stated, all the products come with one (1) year limited manufacturer’s warranty during normal use conditions. Customers must show the proof of purchase with any warranty claims. The warranty is not transferable. Damages caused by fire, flood, earthquake, termites or other force majeure are not covered by this warranty.
2. This warranty is NOT applicable to: a) Any products or parts that have been altered or modified, damaged in transit, defective installation, under extreme temperature and/or moisture levels, abnormal use, wear and tear, or abrasive cleaning chemicals. b) Any products used or installed in conjunction with DKBC products, such as plumbing fixtures or appliances. c) Any close-out, clearance, floor model, final sale items. d) Any open joint line cracks of cabinets. e) Discoloration for painted cabinets. f) Pre-cut countertops.
3. This warranty is limited to the cost of replacement of defective parts ONLY and does not include service, labor, or transportation charges. IN NO EVENT shall DKBC be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of its products. DKBC is not responsible for any damage caused by the users or other party’s intentional or negligent conducts.
4. Defect & Damage claim: All claims must be received within five (5) days of pick-up/delivery. All warranty claims MUST be made in written and must have pictures along with a detailed description of the defects. Do not install damaged or defective product, assembly or modification of the products may void claims for damage. DKBC require the faulty item to be brought back to be assessed and for quality control purposes and we will then fix or replace the item providing it is covered under warranty.
5. Return & Exchange: All exchanges or returns must be made within fifteen (15) days from purchase and to be pre-approved by DKBC. Qualifying returns will incur a 20%-30% handling/restocking fees. All items must be returned in original, unopened packaging. The customer is responsible for all return shipping set-up and costs. No return and exchange on assembled, installed, damaged, specially ordered items and products from the US. FINAL SALE on clearance/AS-IS items, display model, assembled cabinets and countertops.
D. PICK-UP, DELIVERY, ASSEMBLEING AND INSTALLATION SERVICES
1. Pick-Up: Warehouse pick up orders are loaded by the customer themselves into their vehicle to avoid any disputes of damage. It is at DKBC team’s discretion to assist with loading. The customer agrees to hold DKBC and its employees harmless in the event that any accident, injury or damages result in loading/unloading. The customer needs to do a piece count against the order list when pick-up, once the pick-up list is signed, the customer agrees that all the items have been received.
2. Delivery: The products will be delivered to the garage/ground level of the job site by using a single driver. Assistance will be required if the order contains any tall units/ panels or heavy items. Items will not be carried further into other floors or into other rooms. All missing items claim must be reported within two (2) days of delivery.
3. Assembling service: All cabinets are flat-packed (un-assembled) unless otherwise stated. Cabinets can be assembled for an additional cost but must be picked up from our showroom. All assembled cabinets are deemed as final sale items.
4. Installation service: DKBC is a material supplier. To better serve our customers, DKBC introduces independent installers to our customers and they follow DKBC quotation and standard. It is the customer’s responsibility to check all items supplied (for size, colour, specification and quality) before installation and to coordinate with the kitchen installer and other trades. The customer understands and agrees that on-site adjustment may be necessary during installation. Additional cost of material and/or labor caused therefrom may be added to the invoiced amount. DKBC does not provide any plumbing, electrical, decoration or other construction work unless otherwise stated.
5. In many instances an installation will not be able to be completed at one time – for example: a) When on-site measurements need to be taken for countertops b) Where part of the kitchen needs to be installed before other dimensions can be determined 3) Where special or indent items have not yet been received into store. For more information regarding cabinets and countertops installation, please refer to “Cabinet Installation Customer Agreement” and/or “Countertops Customer Agreement”.
E. OTHERS
1. It is the customer’s responsibility to ensure: a) The design and/or order list meets their project needs. b) The accuracy of all measurements. c) The design conforms to plumbing, gas fitting, electrical or any other building regulations. d) Appliance manufacturer’s requirements and/or building codes or other requirements are complied with. DKBC holds no responsibility or liability for the errors of above measurement and confirmation. If the changes are made after order placed, additional fee may be charged.
2. Lead times may alter depending on factory work-loads, staff illness, material availability etc. The customer will be advised in advance of any delays but no consequential claims will be accepted for any reasonable delay in quoted lead-time.
3. Any dispute should be first settled down by DKBC and the customer. If a lawsuit is filed for this contract, the losing party is liable for the litigation costs.
4. This contract embodies the whole contract of the parties. There are no premised, terms, conditions or obligations other than those contained herein. And this contract shall supersede all previous communications or agreement, verbal or written, between the parties.
